Your rightsAirline companies are guilty of numerous abuses. In the majority of the cases they refuse to pay the fixed compensation (on the basis of an extraordinary, often fictitious circumstance) laid down in the Regulation (EC) No 261/2004.

Only those passengers with the necessary legal knowledge are able to enforce their rights.

The Regulation (EC) No 261/2004 provides a fixed compensation for passengers traveling to or from a European airport in the event of a delay of 3 hours or more, in the event of a cancellation or in the event of denied boarding (overbooking). The amount of this compensation varies depending on the distance and the destination of your flight.

How long must the delay be before I am entitled to compensation?

Regulation (EC) No. 261/2004 stipulates that passengers are entitled to compensation after 3 hours delay on the arrival time. In addition, the airline must provide mandatory assistance (i.e., meals, drinks, phone calls, and accommodation costs).

In the event that the airline does not offer this assistance, you are entitled to reimbursement of the expenses paid.

How much am I entitled to?

If your flight is delayed, you can claim up to €600 compensation per person.

The amount of compensation varies depending on the distance of the journey.

You are entitled to a compensation of:

  • €250 for all flights whose distance is less than 1,500 km
  • €400 for all intra-community flights over 1,500 km
  • €400 for all non intra-Community flights whose distance is between 1,500 km and 3,500 km
  • €600 for all flights over 3,500 km.

What are the conditions for receiving compensation?

Travel itinerary:

  • If the airline is European: departure or arrival must be at a European airport.
  • If the airline is not European: departure must be from a European airport.

Cause of delay:

Under Regulation (EC) No. 261/2004, passengers are not entitled to compensation if the reason for the delay is due to "an extraordinary circumstance".

An extraordinary circumstance is defined as "an event that could not have been avoided, even if all reasonable measures had been taken".

Some examples of extraordinary circumstances include:

  • Extreme climate conditions
  • Strikes independent of the airline (strikes by air traffic controllers, baggage handlers, etc.)
  • Bird strike (birds entering the jet engine)
  • Political instability
  • Closure of airspace

The following are some causes of delay which are not considered as extraordinary circumstance (and giving the right to compensation):

  • A technical problem
  • Strike by the airline staff
  • Illnesses of the airline staff

What is the time period for filing a complaint?

The time limit varies from country to country. For example, in France, the time limit for taking action is 5 years. In Belgium, on the other hand, the time limit for taking action is only 1 year.

If your flight is cancelled less than 14 days before your departure:

  • either the flight is delayed and you decide to travel anyway

Overbooked flight

Flight overbooking is a practice that airlines use by selling more seats than those available (hoping there would be no-shows).

It should not be confused with the refusal to board related to an administrative problem which the airline is not responsible for, such as an invalid identity card or passport, failure to obtain a visa, error on the plane ticket, etc.). In such cases, according to EC regulation No. 261/2004, unfortunately you cannot claim compensation.

Missed connexions

A missed connection may occur when you book a trip with at least one stop-over. It may be that the first flight has a slight delay, which means that you cannot arrive in time for the second flight. Regulation (EC) No. 261/2004 provides for compensation under certain conditions.

How much am I entitled to?
